This Terms of Use Agreement hereinafter referred to as the "Agreement" may be modified from time to time, and constitutes legally binding terms which applies to your use of MHAppTrack's services, products or websites and is considered an enforceable contract. This Agreement is entered into by and between You and MHAppTrack. MHAppTrack reserves the right to modify this Agreement from time to time at their sole discretion, and any modifications shall become effective immediately once they are published online. By continuing to use MHAppTrack's services, products or websites after any such modification is published constitutes your acceptance to any such modification to the Agreement. Therefore it is important and all Users are recommended to review this Agreement on a regular bases. If for any reason you do not agree to be bound by any such changes, you must immediately discontinue the use of MHAppTrack's services, products and websites.

We reserve the right to amend this Website from time to time, or withdraw it completely along with any services, products or materials we may provide without notice. If for any reason any part or all of services, products or Website is unavailable at anytime for any period, Users agree that MHAppTrack will not be held liable. This includes restrictions to access our products, services or entire Website. Users are responsible for accessing this Website, and insuring that all parties involved with the User are aware of these Terms Of Use and agree to comply with them.

The User agrees that any information provided is governed by our Privacy Policy, and the User consents to all actions we take with respect to your information that is consistant with our Privacy Policy. If you are provided with login credentials along with any other security measures to access our products and services, the User must treat this information as confidential, and it must not be disclosed to any other person or party. User also acknowlege that account login credentials are personal to that individual and the User agrees not to share or allow access to such credentials to any other individual. These Terms Of Use allows Users to utilize our services, products and Website. A User must not reproduce, distribute, modify, publicly display, republish, download, create derivitave works, store or transmit any of the materials on our Website accept for allowed materials used for specific business purposes as provided within a Users account. Any other such use of our services, products or Website not permitted by these Terms Of Use is a breach of this agreement in which the User will be held liable. Such a breach may also violate trademark and copyright laws.

Prohibited Uses & Activity
MHAppTrack reserves the right to investigate any violation of Prohibited Activities and Uses, and such a violation can result in legal action against any individual or User who violates this provision including but not limited to terminating the account of the User responsible of the violation and reporting violations to the proper legal and law enforcement authorities.

Prohibited Activities and Uses include but are not limited to activities or actions that:

• transmit unsolicited emails, messages or comments to the Users of the services and products available through MHAppTrack.
• circumvents or modifies, attempts to circumvent or modify or encourages the attempt to circumvent or modify any type of security or technology that is a part of  MHAppTrack.
• involves the use of bots, worms, viruses or any other type of harmful code or program.
• involves copying, distributing, modifying, scrapping or transmitting any content from the services and products available through MHAppTrack.
• are designed to interfere, disrupt or create a burden on the services and products available through MHAppTrack.
• attempt to impersonate or impersonate MHAppTrack, a MHAppTrack User, a MHAppTrack employee or any other individual, entity or group.
• involves the selling or transferring of your account in any manner to another individual, entity or group.
• involves obtaining information from the services and products available through MHAppTrack to harm, abuse or harass another individual, entity or group.
• involves accepting payment from a third party in exchange for performing any type of commercial activity through the services and products available through MHAppTrack.
• involves disguising headers against any content obtained from the services and products available through MHAppTrack to forge or misrepresent another party as the source of the content.
• involves using any type of scripts, bots or an automated system to harvest email addresses or any other data from services and products available through MHAppTrack for the purposes of sending unauthorized materials or unsolicited emails.
• exploits, harms, or attemps to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.
• involves using the services and products available through MHAppTrack that is inconsistent or in violation any applicable local, state and federal law.

Waver & Severability
Any waiver by MHAppTrack regarding any term or condition set forth in these Terms Of Use shall not be deemed a continuing waiver of such a term or condition by MHAppTrack, and pause or failure by MHAppTrack to assert a provision or right under these Terms Of Use shall not constitute a waiver of such provision or right. If any provision or right under these Terms Of Use should be found invalid, illegal or unenforceable by the court of law, it will be limited to that provision or right, and the remaining Terms Of Use shall remain in place and in force.

Applicable Law
This Agreement will be governed by the laws of the United States and the State Of Texas, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the federal or state courts having jurisdiction and venue in or for Montgomery County, Texas and User irrevocably consents to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. MHAppTrack's failure or agreement not to enforce a User's violation of any provision of this Agreement in a given instance will not constitute a waiver of MHAppTrack's right to subsequently enforce such provision or any other provision of this Agreement.
